1. Scope of Application

These Terms and Conditions (T&Cs) apply to all orders placed via the online shop of Hive Ventures GmbH, c/o Business Park Industrie AG, Industriestrasse 24, 6300 Zug, Switzerland (hereinafter “Tipsy Tea”, “we”, or “us”).

Any deviating terms and conditions of the customer shall not be recognized unless we expressly agree to their validity in writing.

2. Youth Protection and Alcohol Law

2.1 The sale and distribution of alcoholic beverages are subject to Swiss Alcohol Law (AlkG).

2.2 Tipsy Tea is an alcoholic beverage. Sales are made exclusively to persons who are at least 18 years old.

2.3 By placing an order, you confirm that you are at least 18 years old.

2.4 To comply with Swiss youth protection regulations, all orders are subject to a mandatory age verification process. This includes an identity check (ID verification) via a secure third-party verification service during or after checkout.

2.5 You agree to complete this verification process promptly upon request. If the required verification is not successfully completed within a reasonable period, we reserve the right to cancel the order.

2.6 In such cases, the purchase price will be refunded minus a processing fee of CHF 10.

2.7 We further reserve the right to verify the customer’s age prior to delivery by appropriate measures (e.g., additional age verification or ID check upon delivery).

2.8 Please drink responsibly. Alcohol abuse is harmful to your health.

3. Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue.

3.2 By clicking the “Buy now” button, you submit a binding order for the goods contained in your shopping cart.

3.3 The confirmation of receipt of your order is sent automatically by email and does not yet constitute acceptance of the contract. The contract is only concluded upon our explicit acceptance or upon dispatch of the goods.

4. Prices and Shipping Costs

4.1 All prices are stated in Swiss francs (CHF) and include statutory value-added tax (VAT).

4.2 Shipping costs are shown separately during the ordering process.

4.3 Any customs duties or import fees for international deliveries are borne by the customer.

5. Delivery and Shipping

5.1 Shipping is carried out exclusively to delivery addresses in Switzerland and the Principality of Liechtenstein.

5.2 Delivery time is generally 2–5 working days after receipt of payment.

5.3 If a product is temporarily unavailable, we will inform you by email about the expected delivery date.

6. Payment

6.1 Payment can be made by credit card, TWINT, prepayment, or other payment methods offered in the shop.

6.2 In the event of late payment, we reserve the right to charge reminder fees and default interest.

7. Right of Withdrawal / Returns

7.1 Due to the nature of our products (food & alcoholic beverages), there is no statutory right of withdrawal.

7.2 Returns are only possible if the goods were delivered defective or damaged. In such cases, the damage must be reported within 48 hours of receipt by email to drink@tipsytea.ch.

8. Liability

8.1 We shall only be liable for damages caused by intent or gross negligence.

8.2 Any liability for consequential or indirect damages is excluded.

9. Copyright

All content (texts, images, graphics, logos) on this website is protected by copyright and may not be reproduced or used without the express consent of Hive Ventures GmbH.

10. Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, which forms an integral part of these T&Cs.

11. Applicable Law and Jurisdiction

11.1 Swiss law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 The place of jurisdiction for all disputes is the registered office of Hive Ventures GmbH, 6300 Zug, Switzerland.
